LinkNFC Terms of Service

1. Acceptance of the Terms of Use
These terms of use ("Terms") are entered into by and between Tradinget Ltd, the provider of the LinkNFC product(s) and service(s) ("LinkNFC," "Company," "we," or "us"), and the users of the LinkNFC service(s) ("Service"). By accessing or using the Service, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Product or Service of LinkNFC.
2. Eligibility
The Service is offered and available to users who are 18 years of age or older. By using the Service, you represent and warrant that you are of legal age to form a binding contract with the Company or possess the legal consent of your parent or guardian to access and use the Service.
3. Changes to the Terms of Use
We may revise and update these Terms from time to time in our sole discretion. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. It is your responsibility to check this page periodically for updates.
4. Accessing the Service and Account Security
We reserve the right to withdraw or amend the Service, and any aspect of it, in our sole discretion without notice. You are responsible for making all arrangements necessary for you to have access to the Service and ensuring that all persons accessing the Service through your internet connection are aware of these Terms.
5. User Data and Privacy
To access the Service, you may be required to provide certain registration details and information. Your use of the Service is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.
6. Intellectual Property Rights
The Service and its entire contents are owned by the Company, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws. You are permitted to use the Service for your personal, non-commercial use only. Any use of the Service not expressly permitted by these Terms is a breach of these Terms.

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- In any way that violates any applicable law or regulation.
- For the purpose of exploiting or harming minors.
- To send unauthorized advertising or promotional material.
8. User Contributions
The Service may allow users to post content or materials ("User Contributions"). User Contributions must comply with the Content Standards set out in these Terms. By providing any User Contribution, you grant the Company the right to use, reproduce, modify, display, and distribute the material.
9. Messaging and Invitations
The Service may enable users to send messages and invitations. The Company may monitor messages for compliance with these Terms, and you agree that messages should not be considered confidential. You are responsible for all fees associated with sending invitations.
10. Governing Law and Jurisdiction
All matters relating to the Service and these Terms are governed by and construed in accordance with the laws of Lagos, Nigeria. Any legal action or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the courts of Lagos, Nigeria.
11. Changes to the Service
We may update the content on the Service from time to time, but its content is not necessarily complete or up-to-date. We are under no obligation to update such material.
12. Information About You and Your Use of the Service
All information we collect is subject to our Privacy Policy. By using the Service, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.
13. Limitation on Liability
To the fullest extent provided by law, in no event will the Company, its affiliates, or their licensors be liable for any damages arising out of or in connection with your use of the Service.
14. Refund and Return Policy
Under no circumstances will a user be eligible for a refund or return of any services purchased through the LinkNFC service.
15. Indemnification
You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from any claims arising out of your violation of these Terms or your use of the Service.
16. Account Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including if we believe that you have violated these Terms or engaged in any fraudulent, abusive, or unlawful activity. Upon termination, your right to use the Service will immediately cease. If your account is terminated for any reason, you will not be entitled to any refunds for any unused portion of the service.
17. Third-Party Services
The Service may integrate with third-party services or applications. Your use of such third-party services is subject to their respective terms and conditions. We are not responsible for any third-party services, and your use of such services is at your own risk.
18. Modification of Service
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
19. Feedback
If you choose to provide us with any feedback, suggestions, or comments regarding the Service ("Feedback"), you hereby grant us an irrevocable, perpetual, worldwide, royalty-free license to use, modify, distribute, and incorporate such Feedback into our products and services.
20. Waiver and Severability
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
21. Prohibition on Misuse of Affiliate Profiles
Affiliate accounts are intended for promoting LinkNFC services in accordance with our affiliate program guidelines. Any misuse of affiliate profiles for personal business or unrelated promotional activities is strictly prohibited. If we determine that an affiliate account is being used for personal business purposes or engaging in activities that violate these Terms, we reserve the right to issue a warning to the affiliate. If the misuse persists and the affiliate fails to rectify the details on their affiliate landing page from their own business page within a reasonable timeframe after receiving the warning, the affiliate will be permanently banned from the affiliate program. Additionally, we reserve the right to remove any account at any time without prior notice if we believe it is in violation of these Terms or for any other reason at our discretion.

This document constitutes the entire agreement between you and LinkNFC (Tradinget Ltd) regarding the use of the LinkNFC service.
